HCMUD 167 - Celebrate The New Year Safely

Harris County Municipal Utility District No. 167 (HCMUD 167) hopes your family’s holiday celebrations are fun and safe for everyone. Although fireworks and celebrations go together, especially during the holiday season, they can be dangerous when used improperly, causing serious bodily injury and property damage.

In Houston, anyone who uses fireworks within city limits will be fined $200-$5,000 for each firework. Parents and guardians will be fined if a minor possesses and/or uses the fireworks. Texas House Bill No. 1813 does allow for the transportation of fireworks; however, some cities prohibit taking fireworks from the outskirts and then bringing them into the city. There are current restrictions such as where the fireworks are located in a vehicle and whether the items are opened or unopened. Residents should familiarize themselves with City of Houston and Harris County fireworks ordinances before purchase or use.

According to the Houston Fire Department, investigators and inspectors will patrol areas, confiscate illegal fireworks, and assess fines. They have also broadcast a public service announcement as a reminder.

Fireworks can be purchased in some unincorporated areas of Harris County. Restrictions include near churches, hospitals, or certain schools, among other locations, unless the person receives authorization in writing from that organization, according to the City of Houston's website.

To report illegal use of fireworks, please call the Houston Police Department at 713-884-3131. The Houston Police Department is reminding the community to not shoot into the air as a holiday celebration. Celebratory gunfire is always illegal in Texas cities with a population greater than 100,000. The crime of illegal discharge of a firearm within city limits is a misdemeanor punishable by as much as $4,000 in fines and one year in jail. Firing a celebratory bullet that harms another person could lead to a felony charge of deadly conduct, punishable by a prison sentence of 2 to 10 years.
